Still want to make a retrospective care fees claim?
Final care fees reclaim deadlines have passed – but here’s what to do…
We’re still receiving enquiries from families who want to claim back care fees. Some of these families are aware that the deadlines have now passed, but some aren’t.
The last deadline was 30th March 2013. Prior to that, families were able to make a claim for care fees wrongly charged right back to 2004.
However, an appalling (yet predictable) lack of publicity by the NHS itself means that many people are still unaware of this. And not only are they unaware of the deadlines, they were unaware in the first place that their relative may have been entitled to NHS Continuing Care funding all along.
It’s an appalling state of affairs, created wholly by the health and social care authorities failing to make people aware of the funding they’re entitled to and, instead, falsely taking away personal assets in exchange for healthcare that is free of charge to the rest of the population…
At Care To Be Different we’re hoping that someone will challenge these spurious deadlines through the courts, as they are highly questionable. If any other organisation overcharged a customer tens (sometimes hundreds) of thousands of pounds and then just decided to no longer make any refunds there would be uproar. And yet the NHS assumes it can get away with it.
If you’re still wondering whether you can make a claim, our advice is as follows:
Contact the NHS and follow the steps outlined in our previous article here.
Important! Be sure to state that you were never properly informed by the health and social care authorities about NHS Continuing Care funding, nor about the deadlines, and therefore you insist on having your claim reviewed.
There’s no guarantee the NHS will agree to look at the claim, but you have nothing to lose by writing.
If the NHS refuses to look at your claim, you may need to take legal advice to pursue things further. If you’d like us to put you in touch with one of our trusted legal advisers for an initial chat, contact us.
If the NHS does agree to look at your claim, they may send you some initial forms to complete in the first instance. Be very careful how you fill these in, as the NHS will use the information you put on the forms to decide whether or not to look further into your case. Contact us if you need any help at that point.
